The Herdsman Ear Tag – Lifetime Guarantee Terms & Conditions

Thank you for choosing The Herdsman livestock ear tags (“Products”). We are committed to the quality and durability of our Products and are pleased to offer a Lifetime Guarantee against breakage, defects in material and workmanship, and laser imprint illegibility. For the purposes of this Lifetime Guarantee, "lifetime” refers to the lifespan of the animal to which the Product is originally applied. This guarantee does not extend to the reuse of Product on additional animals.

Please carefully review the following terms and conditions of the Lifetime Guarantee to fully understand its scope, coverage, exclusions, and claim process.

Coverage

This Lifetime Guarantee provides coverage under the following conditions:

  • Tag Breakage: Replacement will be provided at no cost to you if a Product breaks under normal, intended use.
  • Defects in Material and Workmanship: Any defect in materials or workmanship that compromises the performance of the Product will be covered.
  • Laser Imprint Legibility: If the laser-etched imprint becomes illegible due to fading or wear occurring under normal use conditions, the Product will be replaced free of charge.

 Eligibility Requirements

To qualify the Product for a replacement under the Lifetime Guarantee, the following conditions must be met:

  • The Product must have been purchased directly from an authorized dealer or distributor of The Herdsman products and must be Datamars genuine product.
  • Proof of purchase may be required, such as receipt, invoice, or other verifiable purchase record.
  • The defective or broken Products must be returned promptly to Datamars upon request for evaluation.
  • In certain cases, you must permit an authorized Datamars’ representative to conduct an in-person inspection for the purpose of determining the cause of failure. Failure to cooperate with reasonable inspection requests may result in denial of the claim.

Exclusions

This Lifetime Guarantee does not apply in the following situations:

  • Improper Application or Placement: Product is lost or damaged due to improper application, incorrect placement, removal, or misuse.
  • Unauthorized Application Tools: Product not applied using a compatible Datamars applicator. Compatible application tools include the following Datamars products: Herdsman II Tagger (930 0200-975), Universal Tagger (700 0800-119), Z2 No-Tear-Tagger™ (930 0100-225), and Tissue Tagger (800 0800-123).
  • Alteration or Tampering: Products that have been altered, tampered with, or modified after purchase by you or any other unauthorized third party.
  • Reuse on Additional Animals: Products that have been removed and reapplied to a different animal.
  • Damage from Environmental or External Causes: Any damage resulting from fire, flood, chemical exposure, extreme weather and environmental conditions, or other misuse or abnormal conditions.

How to Make a Claim

To initiate a claim under this Lifetime Guarantee:

  • Contact your representative or our Customer Service team at customerservice@datamars.com or (800) 433-3112.
  • Provide the following:
    • A detailed description of the issue
    • Clear photos of the Product in question
  • If Datamars determines that the claim is valid, Datamars will, at its sole discretion, either (a) arrange for a replacement Product to be shipped to you or (b) refund the Product's purchase price. The return of the original Product may be required for inspection.

Limitations

This Lifetime Guarantee is subject to the following limitation of liability:

  • This Lifetime Guarantee applies only to genuine Datamars products manufactured by or for Datamars and is valid only in the original country of purchase. Warranty claims originating outside the country of original purchase will not be processed.
  • To the maximum extent permitted by applicable law, Datamars’ liability under this Lifetime Guarantee is strictly limited to either, under Datamars’ sole discretion:
  1. the replacement of the defective Product. The replacement Product will be of the same type, color, and size whenever possible. If discontinued, a comparable substitute may be provided; or
  2. a refund of the original purchase price
  • The lifetime Guarantee is exclusive, personal to you, and in lieu of all other warranties, representations, or conditions relating to this Product, whether express or implied, and whenever arising under statute, law, trade usage, or otherwise. No other warranties or guarantees shall apply unless expressly agreed to in writing by Datamars.
  • Datamars’ liability is limited strictly to the replacement or refund of the defective Product as described above. No other remedies, including compensation for incidental, indirect or consequential damages, including but not limited to livestock identification, herd or data management, loss of animal records, or resulting economic, commercial or operation loss and damage, shall be available under this Lifetime Guarantee.
  • For the sake of clarity, Datamars shall have no liability for any damage or failure arising from causes expressly excluded under the terms of this Lifetime Guarantee.

Legal Disclaimer

Datamars reserves the right to modify or discontinue this Lifetime Guarantee at any time without notice to you. Excessive, abusive or fraudulent claims may void eligibility. Datamars also reserves the right to reject any claim or decline future sales to customers found to be misusing the Lifetime Guarantee.
